What we offer you when buying real estate
1. you have made the most important decision in your “foreign real estate purchase” campaign. You have decided on a property, your property. You are at least 75% sure that it is your property. There is no such thing as a 100% object. There is nothing 100% in this world. You have also heeded the advice of my estate agents: Please evaluate the location of the property 3 times when making your purchase decision! Now only your “fears” can prevent you from having your decision notarized.
2 The next step is the transfer of ownership. We will put you in touch with a local lawyer. This lawyer has always proven to our firm that he is one of the best specialist lawyers in his field. He will also want to prove to you that he is constantly guided by his professional goal of working flawlessly. Of course, you can appoint a lawyer yourself at any time. However, this must be registered in Croatia.
You instruct this lawyer with the transfer. The lawyer, “your” lawyer, will check all the paperwork and draw up a property purchase contract. Your lawyer takes responsibility for his work and will usually charge 1.5 % – 2.0 % of the purchase price as a fee for this paperwork. His work also includes the application for entry in the land register in Zagreb as well as an official German translation of the real estate purchase contract. If your lawyer gives the green light for your purchase, this real estate contract can be ready to sign in one to two days. If legal work is still required for the sales documents, e.g. the latest extract from the land register or a building land confirmation from the municipality must still be requested, then a so-called real estate pre-contract can also be concluded.
The purchase price is fixed once and a fixed date is set for the subsequent main contract. A down payment, which is usually 10% of the purchase price (called Kapara in Croatia), gives the whole thing financial weight. The seller must repay this deposit twice if he does not have the papers for his property ready for sale by the specified date. However, you will lose this deposit if you withdraw from the purchase without a valid reason.
Your lawyer or we will advise you on whether you should choose another option and pay the deposit into a lawyer’s account (escrow account). We are familiar with all the special features of the region and see it as our task to shed light on the background in order to guarantee optimum purchasing security. Although I take it for granted, I would like to emphasize that this purchasing security is a top priority in our company.
